FrackBusters NY Goes Public with Criminalization Law!

CPNY affiliate FrackBusters NY has unveiled Public Law No. 1 in the NYS Penal Code — a law that criminalizes fracking and frackers. We all know fracking and related activities are a crime against people and nature. We don’t “regulate” crimes. We prosecute them, and make the criminals pay. This law imposes stiff penalties on criminals who engage in fracking or water withdrawal for fracking or transportation of fracking materials or wastes through New York State. The penalties include fines and jail time for corporate officers and executives of fracking companies. Read NYS Public Law Number 1.

Incidentally, FWIW, the United States is party to the unwieldly-titled Environmental Modification Convention (ENMOD), formally the Convention on the Prohibition of Military or Any Other Hostile Use of Environmental Modification Techniques, and I think a case could be made that since fracking is an environmental modification technique utilized by a set of people with a well-known hostility to opponents (It could also be argued that since its disadvantages are well known, and its threat to the environment is well documented, that anyone arguing in its favour is showing hostility towards a civilian population. The UN would buy that.), it would appear prima facie that making fracking illegal is merely patriating the Environmental Modification Convention (ENMOD), formally the Convention on the Prohibition of Military or Any Other Hostile Use of Environmental Modification Techniques, into US domestic legislation.
